BookPowered Terms of Service

These Terms are a binding agreement between you and Mindful Guidance LLC, doing business as BookPowered (“BookPowered,” “we,” “us,” or “our”). They govern the BookPowered website and all strategy, research, positioning, campaign preparation, outreach management, software, and related services.

By checking the agreement box at enrollment, purchasing a plan, or using the services, you confirm that you have read, understood, and agreed to these Terms and have authority to enter into this agreement.

Terms at a glance

This summary is provided for easier review. The complete numbered sections below govern.

1. What BookPowered provides

BookPowered helps nonfiction authors identify and reach people and organizations who may be able to advance an author’s ideas, expertise, mission, or commercial objectives. Potential pathways include media and authority, speaking and training, consulting and business development, community building, organizational adoption and bulk sales, and mission-driven impact.

Depending on your plan, services may include outcome strategy, author and book positioning, contact research, fit analysis, campaign organization, recipient-specific outreach materials, a dedicated BookPowered-managed campaign domain and mailbox, sending support, response management, follow-up support, reporting, and related administrative services. Your checkout summary and any written addendum describe the services included in your plan.

2. No guarantee of responses, revenue, or outcomes

BookPowered does not guarantee any response, introduction, placement, interview, feature, event, speaking engagement, consulting client, partnership, community member, adoption, bulk order, sale, revenue, profit, ranking, reputation improvement, or other outcome. Outreach volume is not a promise of positive responses.

Every recipient and organization acts independently and may decline, ignore, postpone, change, or withdraw an opportunity at any time. Results may depend on matters outside our control, including the quality and relevance of the book, offer, materials, claims, timing, distribution, pricing, market conditions, audience fit, and the author’s conduct and follow-through.

3. Author responsibilities and representations

You are responsible for your book, business, claims, credentials, offers, pricing, availability, conduct, contracts, and materials. You agree to provide complete and accurate information, working links, timely approvals, and lawful content.

You represent that you own or have permission to use every excerpt, cover, review, testimonial, biography, image, trademark, link, and other item you provide, and that your materials and instructions do not infringe rights, mislead recipients, or violate law. You are responsible for reviewing and approving positioning, factual claims, offers, and message templates before use.

4. Outreach authorization and communications

Campaign Desk clients control their replies, calls, decisions, and next steps. Managed Outreach clients authorize BookPowered to prepare and send communications within the positioning, templates, limits, and campaign guidelines they approve. Personalization may vary by recipient while remaining within the approved foundation.

We may share an approved calendar link or proposed next step, but we do not accept an interview, appearance, engagement, date, fee, travel request, contract, order, partnership, or other commitment on your behalf unless a separate signed agreement expressly authorizes that action. We may suppress contacts, pause sending, or change delivery schedules to protect recipients, sender reputation, legal compliance, and provider requirements.

5. Independent third parties

Recipients, event hosts, interviewers, reviewers, vendors, platforms, venues, buyers, partners, and organizations are independent third parties. BookPowered does not investigate, supervise, control, warrant, or endorse their statements, policies, safety, conduct, products, services, contracts, or opportunities.

You decide whether to communicate, meet, travel, appear, contract, pay, deliver, share information, or participate in any resulting relationship or activity. You are responsible for due diligence, professional advice, personal safety, travel, insurance, permissions, contracts, taxes, and business decisions.

6. No professional advice

BookPowered provides marketing, research, technology, and administrative services. Information, suggestions, templates, reports, and AI-assisted drafts are not legal, financial, tax, investment, publishing, safety, or other professional advice.

7. Fees, renewals, guarantee, and cancellation

Fees, introductory pricing, renewal timing, and recurring charges are shown on the BookPowered pricing page and again at checkout. Your upfront launch fee includes campaign launch and your first three months of service. Beginning in month four, the monthly subscription rate shown for your selected plan at checkout is charged until canceled. If the pricing page and checkout differ, the checkout summary you accept controls.

21-day money-back guarantee. For new purchases under this agreement version, the guarantee begins on the initial purchase date. You may request cancellation and a refund through the contact form within 21 calendar days after that date. Onboarding delays, campaign preparation, author approvals, domain provisioning, and mailbox warm-up do not pause, restart, or extend the period. If a qualifying refund is issued, BookPowered will refund the amount paid and stop the campaign.

After the guarantee period, fees earned for completed or committed strategy, setup, research, writing, provisioning, and campaign-management work are non-refundable except where required by law. Canceling the monthly subscription stops future renewal charges and ends active outreach at the conclusion of the paid service period. Access to the Opportunity Desk, campaign records, mailbox, and incoming messages then ends. BookPowered-managed domains and mailboxes are owned, administered, and retired by BookPowered as service infrastructure and are not transferred to the author.

8. Acceptable use and campaign termination

You may not use BookPowered for unlawful, deceptive, infringing, defamatory, abusive, discriminatory, harassing, fraudulent, or unsolicited mass communications. You may not misrepresent identity, credentials, reviews, sales, affiliations, evidence, or outcomes.

Keeping a campaign active requires continued payment of the applicable monthly service fee. A request to pause the campaign or stop that fee is treated as cancellation unless we agree otherwise in writing. We may suspend or terminate activity when continuing could violate law, recipient requests, provider rules, deliverability standards, these Terms, or another person’s rights.

9. Private research and contact information

Mindful Guidance LLC’s shared master contact directory, including the BookPowered classifications and eligibility data used to serve BookPowered clients, together with our research methods, prospect lists, verification work, fit evidence, and recipient contact details, is confidential business information. You may not scrape, copy, resell, disclose, reverse engineer, or use private directory information outside the service. Contact information can become outdated, and we do not warrant that every address, title, person, or organization remains accurate or available.

10. Intellectual property

You retain ownership of your book and materials you provide. You grant BookPowered a limited license to store, format, reproduce, and use those materials as reasonably necessary to provide the services.

Mindful Guidance LLC retains ownership of BookPowered software, databases, research, methods, templates, workflows, branding, service materials, and managed infrastructure. Subject to these Terms and payment, you may use materials prepared specifically for your campaign for your own business and promotion.

11. Third-party services and availability

The service depends on third-party websites, directories, email providers, payment processors, hosting, AI services, analytics, and other platforms. Their rules, data, pricing, availability, and functionality may change or fail. We may adjust workflows, replace providers, delay sending, or use reasonable substitutes. We do not promise uninterrupted or error-free service.

12. Disclaimer of warranties

To the fullest extent permitted by law, the website and services are provided “as is” and “as available.” Mindful Guidance LLC and BookPowered disclaim all express and implied warranties, including merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and availability. No statement creates a guarantee unless it appears in a written agreement signed by an authorized representative.

13. Limitation of liability

To the fullest extent permitted by law, Mindful Guidance LLC, BookPowered, and their owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, consequential, reputational, or lost-profit damages, or for lost data, opportunities, business, or third-party claims arising from the website, services, outreach, recipients, or resulting relationships.

Their combined total liability for claims related to a service will not exceed the amount you paid BookPowered for that service during the three months immediately preceding the event giving rise to the claim. Nothing limits liability that cannot lawfully be limited.

14. Indemnification

To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Mindful Guidance LLC, BookPowered, and their owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable costs arising from your book or materials, instructions or claims, breach of these Terms, violation of law or another person’s rights, or a relationship, contract, communication, event, transaction, or activity you pursue.

15. Privacy and electronic records

Our Privacy Policy explains how we handle information. You consent to receive service records, notices, approvals, and agreements electronically. At checkout we may retain the accepted agreement version and text, acceptance time, checkout session, IP address, and browser information as evidence of the transaction.

16. Governing law and venue

These Terms are governed by Florida law without regard to conflict-of-law rules. A dispute not resolved informally will be brought in a state or federal court with jurisdiction in Broward County, Florida, and each party consents to that jurisdiction and venue.

17. General terms

These Terms, the Privacy Policy, checkout summary, and any signed addendum form the complete agreement concerning the services. If a provision is unenforceable, it will be limited to the minimum extent necessary and the remainder will continue. A waiver must be in writing. You may not transfer this agreement without written consent. We may assign it as part of a merger, reorganization, sale, or transfer of the business.

18. Changes

We may update these Terms as the service changes. The current version and effective date will be posted here. The agreement version accepted at checkout remains part of the record for that enrollment.

19. Contact

Questions about these Terms may be sent through the BookPowered contact form.
